About these terms
These Website Terms of Use govern your access to and use of the thinking.fish website (the "Site") operated by Thinking Fish Ltd ("Thinking Fish", "we", "us" or "our"), a company registered in England and Wales under company number 03637036, with its registered office at 4.01 The Tea Building, 56 Shoreditch High Street, London, E1 6JJ.
By accessing or using the Site you agree to these terms. If you do not agree to them, please do not use the Site.
Other terms that apply
These Website Terms of Use apply to your use of the Site itself. Other terms apply to the goods and services you buy from us, and form part of your agreement with us where relevant:
- Our Terms and Conditions for the sale of goods and services govern any order you place and any contract for products and services.
- Our Domain Name Terms and Conditions govern the registration, renewal and management of domain names.
- Our Privacy Policy explains how we handle your personal data.
- Our Abuse, Illegal and Complaint Reporting policy and our Complaints Procedure explain how to report problems and how complaints are handled.
Where there is any conflict between these Website Terms of Use and the Terms and Conditions for the sale of goods and services or the Domain Name Terms and Conditions in relation to an order, those sale terms take precedence for that order.
Changes to these terms and the Site
We may amend these terms from time to time. The latest version is the version published on the Site, with the "last updated" date shown above; your continued use of the Site after a change takes effect means you accept the revised terms.
We may update, change, suspend or withdraw all or any part of the Site at any time, and we do not guarantee that the Site, or any content on it, will always be available or uninterrupted.
Your account
Some features, such as the My Account area, require you to sign in. We use a passwordless sign-in: you enter your email address and we send you a one-time login code. You are responsible for keeping access to your email account secure, and for any activity that takes place under your account.
You must provide accurate, current and complete information when you create an account, place an order, or submit a form, and keep that information up to date. Tell us promptly if you believe your account has been accessed without your authorisation.
Acceptable use of the Site
You may use the Site only for lawful purposes. You must not:
- Use the Site in any way that breaches any applicable law or regulation, or is fraudulent or harmful.
- Attempt to gain unauthorised access to the Site, the server on which it is hosted, or any connected system; or interfere with, damage or disrupt the Site.
- Introduce viruses, malware or other harmful material, or carry out any denial-of-service or similar attack.
- Use any automated system, scraper or bot to access, copy or harvest content or data from the Site except as we expressly permit.
- Use the domain search or WHOIS lookup tools to compile or send unsolicited communications, or for any unlawful or abusive purpose.
- Misuse the Site to register domains, place orders or impersonate others fraudulently.
We may suspend or withdraw your access to the Site, and report activity to the relevant authorities, if you breach this section. Abuse can be reported to us under our Abuse, Illegal and Complaint Reporting policy.
Domain search, availability and WHOIS
The Site lets you search for domain name availability and look up public registration (WHOIS / RDAP) records. This information is obtained in real time from third-party domain registries and registrars.
Availability results and prices shown are indicative only and are not a guarantee that a domain can be registered, or registered at the price shown; availability and pricing are ultimately determined by the relevant registry at the time of registration. A domain is only secured once your order is confirmed and the registration completes.
WHOIS / RDAP results are provided by third parties and may be incomplete, redacted for privacy, or out of date. You may use them only for lawful purposes, and you must not use them to send unsolicited communications or for any abusive purpose.
Orders, pricing and payment
Placing an order through the Site is an offer to buy. A binding contract is formed only as set out in our Terms and Conditions for the sale of goods and services. Domain registrations are also subject to our Domain Name Terms and Conditions and to the rules of the relevant registry.
We take reasonable care to ensure prices and product information on the Site are correct, but errors can occur; if we discover an error affecting your order we will let you know before proceeding. Unless stated otherwise, prices are shown excluding VAT, and VAT is added at checkout where applicable.
Card and Apple Pay payments are processed securely by our payment provider, Judopay. We do not receive or store your full card details. By paying, you confirm you are authorised to use the payment method.
Intellectual property
The Site and all content on it - including text, graphics, logos, the Thinking Fish name and brand, and the design and software of the Site - are owned by or licensed to Thinking Fish and are protected by intellectual property laws.
You may view and use the Site for your own legitimate purposes as a customer or prospective customer. You may not copy, reproduce, republish, distribute or exploit any part of the Site for commercial purposes without our prior written permission.
Third-party links and services
The Site may link to, or rely on, third-party websites and services (for example domain registries, our payment provider, and analytics). Those links and services are provided for convenience and are governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party sites and services.
Disclaimers
The Site and its content are provided on an "as is" and "as available" basis. While we work to keep the information on the Site accurate and up to date, we do not warrant that it is complete, current or error-free, particularly information sourced from third parties such as domain availability and WHOIS data.
Nothing in these terms affects the statutory rights you have as a consumer, where they apply.
Our liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so - including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Subject to that, we are not liable for any loss or damage arising from your use of, or inability to use, the Site, or from reliance on any content on it. Our liability in connection with the goods and services you buy from us is governed by our Terms and Conditions for the sale of goods and services.
Privacy and cookies
We process personal data in accordance with our Privacy Policy. The Site uses cookies; strictly necessary cookies are always set, and analytics cookies (Google Analytics) are set only with your consent, which you can manage at any time through the cookie settings on the Site.
Governing law and jurisdiction
These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that if you are a consumer resident in another part of the UK you may also bring proceedings in your home jurisdiction.
